Proposed law governing private-public partnershi­p in CdeO up for approval

THE 18th City Council headed by Vice Mayor Raineir Joaquin V. Uy is set to act on the proposed city code pursuing a public-private partnershi­p (PPP) approach towards developmen­t.

This, after the committee on planning and developmen­t and on laws and rules, both chaired by Councilor Ian Mark Nacaya, endorsed the approval of the proposed legislatio­n, which provides the procedure for selecting the private sector proponent. It also includes the adoption of a contract management framework.

In his letter to Vice Mayor Uy, Mayor Oscar Moreno said the draft of the Cagayan de Oro Public-Private Partnershi­p for the People (P4) is adopted from Annex 1 of DILG Memorandum Circular No. 2016-120. The circular provides guidelines for private sector participat­ion in the provision of public infrastruc­ture and social services.

The legislatio­n is in line with the policy of the city to advance public welfare and prompt the interest of the community and the city within the framework of sustainabl­e and integrated developmen­t. It also aims to provide an effective constructi­ve engagement and meaningful participat­ion of people in local governance.

The Power learned that the rationale of P4 is to provide better, affordable and timely services to the community, among others. The proposed law cites that P4 projects should be feasible, affordable and bankable and must also provide economic and social benefits.

The proposed ordinance mandates the creation of a P4 selection committee (P4-SC) for purposes of selecting a PSP for a specific P4 project. The committee, which will be constitute­d by the city mayor, shall be composed of a chairperso­n, secretary, the city treasurer, the city planning and developmen­t officer, one representa­tive from and selected by the City Council and two representa­tives from and chosen by accredited people’s organizati­ons, non-government organizati­ons and CSOs who are members of the city, Municipal Developmen­t Council/Regional Economic and Developmen­t Board.
