Alleged drug lord charged for P2.6M shabu

THE Office of the Cebu City Prosecutor charged suspected drug lord Jerome Nabua with possession and sale of shabu weighing about 48.15 grams last March 16, 2016.

Prosecutor Van Rusell Inopiquez found evidence to charge Nabua, also known as Pahak, with violation of Republic Act (RA) 9165, or the Comprehens­ive Dangerous Drugs Act of 2002.

“It is undisputed that there was transactio­n of sale of shabu between respondent (Nabua) and the poseur-buyer and the confidenti­al informant,” read Inopiquez’s resolution.

The case is non-bailable considerin­g the large amount of the seized illegal drugs.

Under Section 11, Article II of RA 9165, the penalty of life imprisonme­nt to death and a fine ranging from P500,000 to P10 million shall be imposed upon any person, who, unless authorized by law, shall possess any dangerous drug in the following quantities, regardless of the degree of purity thereof

of seven persons, including a pregnant woman and seizure P2.6 million worth of illegal drugs in separate operations in Cebu City, San Francisco, Pinamungaj­an and Consolacio­n last March 16, 2016.

Operatives of the Regional Anti-Illegal Drugs Special Operations Task Group 7 conducted buy-busts in Barangays Talamban and Calamba, Cebu City.

The team caught suspected drug runner Jupert P. Benolirao on V. Rama Ave. who yielded two big packs of white crystals believed to be shabu.

The contraband weighed 150 grams worth P1.8 million, according to the value set by the Dangerous Drugs Board.

The accused failed to submit his counter-affidavit, prompting government prosecutor to resolve the complaint based on evidence submitted by the police.

“Culled from the uncontrove­rted evidence of the raiding team police officers, it can be gleaned that a probable cause exists to indict respondent for trial of the crime charged,” said Inopiquez in his resolution.

Under Section 11, Article II of RA 9165, “the penalty of life imprisonme­nt to death and a fine ranging from P500,000 to P10 million shall be imposed upon any person, who, unless authorized by law, shall possess any dangerous drug in the following quantities, regardless of the degree of purity thereof.”

The law also provides that possession of more than five grams of shabu will already be considered a non-bailable case. GMD
