A 64-YEAR-OLD man from Consolacion, Cebu is facing criminal charges for allegedly stabbing to death his common-law wife inside a motel in Mandaue City last Oct. 17, 2016.
Prosecutor Mary Francis Daquipil found evidence to charge Ruel Mosqueda with murder before the Regional Trial Court.
“The accused willfully, unlawfully and feloniously stabbed Mercedita Magallanes Emia with the use of a kitchen knife, hitting her in the chest and resulting in her death,” said Daquipil in the charge sheet.
Emia, 48, of Barangay Umapad, Mandaue City, sued her live-in partner for physically and psychologically abusing her last April.
In her complaint-affidavit, Emia said that Mosqueda, of Barangay Jugan Lawis, Consolacion, fetched her from a KTV bar in Mandaue City where she worked as a guest relations officer, last April 3, 2016.
They dropped by another KTV in Mandaue City and drank several bottles of beer.
Emia said she asked Mosqueda to buy her food because she was hungry. When he returned with a cup of noodles, the ac- cused hit the victim in the head with a bottle of beer.
Emia lost consciousness and was taken to the hospital.
The victim tried to break up with the accused because her job would often drive him to jealousy. But Mosqueda threatened to kill Emia if she broke up with him.
Hotel
Last Oct. 17, 2016, the couple checked into a drive-thru motel. A few minutes later, Mosqueda was seen walking out of the room.
When the room attendant saw that the door was half-opened, he called out but no one responded.
When he checked inside the room, the attendant saw the victim sitting on the floor and bathed in her own blood.
The motel management called for police assistance.
After an investigation, police showed to the room attendant a bench warrant of arrest for Mosqueda. The attendant identified the suspect through the photo attached to the document.
The victim’s daughter, Mary Ann Gonzales, executed an affidavit corroborating the statement of the room attendant. GMD
