‘Reinstate DEPW assistant chief’
CSC assails Mayor Osmeña’s order reassigning Engr. Enriquez under the Office of the Mayor
THE Civil Service Commission (CSC) 7 has ordered Cebu City Mayor Tomas Osmeña to reinstate a former assistant department head to her original assignment at City Hall.
In a resolution dated Nov. 21, CSC Acting Director Editha Luzano directed the mayor to submit certified true copies of records relative to the reinstatement of Engr. Kenneth Carmelita Enriquez as the assistant chief of the Department of Engineering and Public Works (DEPW).
“Pursuant to existing Civil Service laws and rules, Mayor Tomas Osmeña is hereby directed to immediately stop the implementation of the assailed July 15, 2016 memorandum and instantaneously restore Engr. Kenneth Carmelita Enriquez to her former function,” read a portion of Luzano’s resolution.
It was on July 15 when Osmeña issued a memorandum reassigning Enriquez under the Office of the Mayor.
She was given a special assignment to come up with a master plan for the improvement of the Cebu City Jail.
During the administration of former mayor Michael Rama, Enriquez was designated as assistant department head of the DEPW. She was also appointed as officerin-charge of the City Planning and Development Office.
Enriquez filed an appeal about her reassignment to CSC after receiving Osmeña’s order.
CSC allows an employee to make an appeal on reassignment orders within 15 days upon receiving it if he or she believes that there is no justification for the reassignment.
Contempt
On what will happen if their decision will not be implemented by the mayor, Luzano invoked the Revised Rules on Administrative Cases in the Civil Services.
It provides that “any officer or employee who willfully refuses or fails to implement the order or the ruling of CSC to the prejudice of public service and affected party may be cited for indirect contempt.”
The acting director added that the officer or employee may also be charged administratively for neglect of duty.
Sun.Star Cebu tried to get Enriquez’s comment on the CSC decision yesterday but she was not available for an interview.
CSC said Osmeña can still make an appeal on their decision within 15 days.
