Bohol Provincial Board Member Niño Rey Boniel, who is accused of kidnapping and killing his wife Bien Unido, Bohol Mayor Gisela Boniel, will return to Bohol after 15 days in Cebu.
The court ordered his transfer in the Talibon District Jail yesterday.
The commitment order was signed by Talibon Regional Trial Court (RTC) Branch 52 Judge Marivic Tarabajo-Daray for Niño to face the charges of kidnapping and serious illegal detention filed by Gisela's best friend, Angela Leyson and her 17-year-old son, in his home province.
"This is the result after we withdrew our waiver of detention and the request for a preliminary investigation because we want to fastrack this case," said Atty. Gerardo Carillo, one of Niño's lawyers.
The police have 72 hours to comply with the order.
Senior Insp. Reslyn Abella, Police Regional Office 7 public information officer, said that they will respect the court's order.
Safety concerns
Carillo raised concern for Niño's security during the transfer and said that their camp will appreciate it if the cases of parricide in Lapu-Lapu and kidnapping and illegal detention in Bo- hol are consolidated.
"We will be glad if the trials will be held in one venue because we are confident of our defense anywhere and evidences should be proven without any reasonable doubt," the lawyer said.
Abella assured that the accused will be secure during his trip back to Bohol either tonight or early morning tomorrow.
"The security measures that we did during his trip here to Cebu will be the same by the time we transfer him to Bohol," Abella said.
Niño's arraignment is set on June 29 in the Talibon RTC.
Dismissal sought
He will also submit his counter-affidavit for the parricide charges in Lapu-Lapu.
Carillo said they will ask the court to dismiss the parricide case after they received reports that Gisela is hiding in Dubai with her Italian boyfriend.
"We will be confirming… these are raw reports, these can be best elevated during trial. There were reports that she passed through backdoor exits to leave the country, from Indonesia to Malaysia, to Dubai," Carillo said in a dyLA report.
Niño's camp will also present the affidavit of two witnesses, including the lifestyle editor of a Bohol whose call was reportedly picked up by the mayor hours after she was allegedly killed.
