COMPLAINTS FILED AGAINST 2 BOYS FOR SPREADING NUDE PHOTO OF TENTH GRADER

Ben, 17, and Larry, 18, are facing separate complaints for allegedly spreading a nude photo of Larry’s ex- girlfriend Joy. Ben was charged with violating Republic Act (RA) 9995, or the Anti-Photo and Video Voyeurism Act of 2009, in relation to RA 10175, or the Cybercrime Prevention Act of 2012. Larry is facing complaints for violating RA 9262, or the Anti-Violence Against Women and their Children Act of 2004 in relation to RA 10175. Joy’s two classmates informed her that her picture was posted on the wall of the school’s official Facebook page.

Two boys, including a minor, are facing criminal complaints for allegedly spreading the nude picture of a 16-year-old 10th grader on social media and the Facebook page of a public school in Mandaue City.

Regional Anti-Cybercrime Office 7 Chief Leo Shiroma Dofiles endorsed the complaints against 17-year-old Ben and 18-year-old Larry to the Mandaue City Prosecutor's Office yesterday morning for allegedly shaming Joy. Larry is Joy's former boyfriend, while Ben is the latter's classmate.

Ben was charged with violating Republic Act (RA) 9995, or the Anti-Photo and Video Voyeurism Act of 2009, in relation to RA 10175, or the Cybercrime Prevention Act of 2012. Larry faced complaints for violating RA 9262, or the Anti-Violence Against Women and their Children Act of 2004 in relation to RA 10175.

Joy sent a picture of herself with her breasts exposed to Larry through Facebook messenger in August last year. Three months later, she broke up with him.

Larry, a resident of Sibonga, did not accept her decision.

“He warned me that he would spread the picture if I didn't reconsider my decision...,” Joy said in her judicial affidavit.

Ben later approached her and told her he had a copy of her nude photo and showed her his cell phone.

Ben did hot delete the photo until a few days later.

Joy's two classmates informed her that her picture was posted on the wall of the school's official Facebook page.

Ben had uploaded the picture, before he deleted it.

Joy later learned that Larry gave the photo to Ben.

In a separate affidavit, Joy's mother said that instead of apologizin­g, Larry and his relatives blamed her daughter for her reckless act.
