EX-COP WANTS COURT TO REVIEW ADMIN RAP

A complaint was filed against the officer after illegal drugs and two fragmentat­ion grenades were found by his superiors inside his locker in December last year.

A former policeman who allegedly kept illegal drugs and explosives in his locker in Bogo City Police Station last year has gone to court to stop his superiors from pursuing the administra­tive cases against him.

Moises Cunanan filed a civil petition for certiorari against the Regional Police Office 7 before the Regional Trial Court in Cebu City.

“Not only did this police officer’s separation from the service prove oppressive and punitive to the policeman, but its effects are also being suffered by his family,” reads Cunanan’s petition.

The National Police Commission dismissed Cunanan, a police officer 1, from service for grave misconduct after 30 grams of suspected shabu worth P354,000 and two fragmentat­ion grenades were found in his locker last Dec. 26, 2017.

A complaint for illegal possession of explosives and violation of Republic Act 9165 or the Comprehens­ive Dangerous Drugs Act of 2002 were also filed against Cunanan before Office of the Bogo City Prosecutor.

In his petition, Cunanan, who was then assigned in Dimiao Police Station in Bohol, alleged that PRO 7 acted with grave abuse of its discretion when it filed the administra­tive cases against him.

He said that the police prosecutio­n ruled without substantia­l evidence and without following the laws and guidelines in disposing of administra­tive cases.

“At the start, nominal complainan­t’s affidavit was all hearsay as he had no personal knowledge of the acts he had charged petitioner as having committed. It was his allegation­s, which do not hold any probative value,” the petition reads.

Cunanan asked the court to issue a temporary restrainin­g order and writ of preliminar­y injunction to stop the respondent from further taking action.

He also asked the court to declare as void the resolution and decision issued against him. /
