CYBERCRIME 2 face cybercrime charges over feud with lawyer

The Office of the Cebu City Prosecutor has indicted two people who allegedly besmirched the reputation of the late lawyer Goering George “Jing” Paderanga, Sr. over a road right-of-way dispute along F. Ramos St., Cebu City.

Prosecutor Fatima Maadil found evidence to charge Lawrence McClay and Lakhiram Mirpuri with violation of the Cybercrime Prevention Act of 2012.

“The letter contains false, public and malicious imputation of a crime or of a vice or defect, which brought great dishonor and discredit to the complainan­t’s reputation,” read Maadil’s resolution.

Barely a week before he and his son were shot dead outside their residence, Paderanga, Sr. sued six people who falsely accused him of extorting P15 million from the developer and contractor of Ultima Prime Residences and for being the reason for the delay of the completion of the condominiu­m project.

Apart from McClay and Mirpuri, also named respondent­s were Rafael King, president of J. King and Sons Co. Inc., and Fuente Triangle Realty Developmen­t Corp.; Manuel Mendoza, presi- dent and chairman of the board of Monocrete Constructi­on Phil., Inc.; Rose Patio, project manager on-site of Monocrete Constructi­on; Josh Beltran, Fuente Triangle sales manager.

Gerick, 37, succumbed to a gunshot wound in the nape barely three days after the shooting.

Goering Sr., 62, who died on the spot after getting shot thrice, was the husband of Judge Sylva Paderanga of the Regional Trial Court Branch 16.

Police arrested Sanchez in his parents’ house in Barangay Talamban, Cebu City.

Sanchez pleaded not guilty to murder during his arraignmen­t before Judge Anacleto Debalucos of the Regional Trial Court Branch 17 last Oct. 2.

In 2014, the Paderangas filed a civil complaint before the Regional Trial Court against Ultima Residences and its contractor, Monocrete Constructi­on, for damaging the private road, alley gutter, water drainage and vehicles of nearby residents.

In her order dated July 31, 2015, Regional Trial Court Judge Ma. Lynna Adviento issued the writ of the preliminar­y injunction stopping Ultima Prime Residences from continuing its project “until proof that mandated safety measures are undertaken to protect the life and property” of the petitioner­s and residents near the constructi­on site.

In the resolution, Prosecutor Maadil found evidence to charge McClay and Mirpuri, both condominiu­m owners, with violating the Cybercrime Prevention Act of 2012.

McClay was the author of the letter while Mirpuri forwarded it to about 100 people via email.

On the other hand, the prosecutio­n dismissed for lack of evidence the complaint against the other respondent­s.
