Cop caught selling shabu in hotel faces charges

A policeman from Cebu City is facing criminal charges in court for selling shabu that weighed about 0.23 gram in September 2017.

Prosecutor Fatima Maadil found evidence to charge PO1 Wilfred Cabillo with violating Republic Act 9165 or the Comprehens­ive Dangerous Drugs Act of 2002.

“As such, the unconteste­d evidence of the arresting officers and the circumstan­ces surroundin­g the arrest of the respondent suffice to arrive at a well-engendered belief that violation of RA 9165 has been committed by the respondent,” said Maadil in the resolution.

Violation of Sec. 5, Art. 2 of the Comprehens­ive Dangerous Drugs Act of 2002, is a non-bailable offense, considerin­g the volume of shabu seized from the policeman.

The case stemmed from the complaint filed by the Regional Police Drug Enforcemen­t Unit 7, which accused Cabillo of violating the anti-drugs law.

Authoritie­s conducted an anti-illegal drugs operations against Cabillo and his alleged cohorts inside at a hotel in Barangay Basak, Cebu City last Sept. 12, 2017.

A policeman, who posed as a buyer, met with Cabillo supposedly to buy shabu. The officer bought shabu worth P1,000 from Cabillo.

The respondent then took four sachets of shabu from his sling bag. But the respondent sensed that it was a drug operation when the officer gave a signal to his backup team.

Cabillo ran toward the alley and eluded arrest. The prosecutor subpoenaed the accused to submit his counter-affidavit, but he failed to submit any.

In the resolution, Prosecutor Maadil said that photograph of pieces of evidence, the chain of custody form, and the result of the laboratory examinatio­n led to Cabillo’s indictment.

“The drug evidence when submitted for examinatio­n gave positive results for the presence of dangerous drugs,” read Maadil’s resolution.
