Dole issues payment rules for June 26

WITH June 26, 2017 being declared by President Rodrigo Duterte as a Regular Holiday for the Eid’l Fitr (Feast of Ramadan), Department of Labor and Employment Secretary Silvestre H. Bello III issued Labor Advisory 08, Series of 2017 to remind employers on the rules on payment of wage for that day.

President Duterte has declared Monday a holiday under Proclamati­on No. 235. “In order to bring the religious and cultural significan­ce of the Eid’l Fitr to the fore of national consciousn­ess, it is necessary to declare Monday, 26 June 2017, as a regular holiday throughout the country,” the proclamati­on reads.

In addition, the proclamati­on also states that, “the entire Filipino nation should have the full opportunit­y to join their Muslim brothers and sisters in peace and harmony in the observance and celebratio­n of Eid'l Fitr.”

As the Filipino Muslim community celebrates this important religious holiday, the Department of Labor and Employment (Dole) reminds employers through the advisory released on Wednesday, June 21, to observe and comply with the Regular Holiday payment of wages:

1. If the employee did not work, he or she shall be paid 100 percent of his or her salary for that day [(Daily rate+ Cost of Living Allowance) x100%]; 2. For work done during the regular holiday, the

employee shall be paid 200% of his or her regular salary for that day for the first eight hours [(Daily rate + Cost of Living Allowance) x 200%];

3. For work done in excess of eight hours (overtime work), he or she shall be paid an additional 30% of his or her hourly rate on said day [Hourly rate of the basic daily wage x 200% x 130% x number of hours worked];

4. For work done during a regular holiday that also falls on his or her rest day, he or she shall be paid an additional 30% of his or her daily rate of 200% [(Daily rate + Cost of Living Allowance) x 200%] + [30% (Daily rate x 200%)]; and

5. For work done in excess of eight hours (overtime work) during a regular holiday that also falls on his or her rest day, he or she shall be paid an additional 30% of his or her hourly rate on said day (Hourly rate of the basic daily wage x 200% x 130% x 130% x number of hours worked).
