During the committee hearing it was emphasized that the principle adopted concerning the written permission required in the proposed Ordinance is the concept of Free Prior and Informed Consent (FPIC) from the respective IP tribe whereby the IP community may be given the opportunit­y to inform the applicant of the significan­ce and proper use of the IP attire that the latter intends to use or exhibit.

“The IP tribe may have the right to withhold their consent or modify the concept of the IP attire that the applicant sought to be exhibited if the same is maliciousl­y or seriously offensive to the norms and culture of the concerns IP tribe,” it read.

It is also recommende­d that to make the proposed ordinance less cumbersome, the applicatio­n for written permission shall be made only once by an applicant thus it will be valid for a lifetime, unless revoked on proper ground, for as long as there is an effective transmissi­on of the IP culture through consultati­on or dialogue with the tribe.

The ordinance applies only to public activities, such as parades, exhibits, exhibits, public gatherings and presentati­on that engage the public in general.

It was resolved during the hearing that the Indigenous Political Structure shall govern who will issue/sign the written consent within the IP community and in the absence of IPS, the concerned tribe shall have to issue a resolution stating who will be issuing authority. The respective IP community shall also promulgate the rules and process in obtaining written consent.

After the third committee hearing, all invitees have agreed to the provisions of the ordinance and hoped that it will be approved before the start of Kadayawan this year.

Section 11 of the proposed ordinance provides for the special permit for Kadayawan and Araw ng Dabaw applicatio­n.

It read that the CTO shall inform the Executive Committee (Execom) designated to supervise the over-all activities of the Kadayawan and Araw ng Dabaw of the provisions of the Ordiannce.
