Unjust vexation charges vs BHW
A PUBLIC health worker is facing charges before the court after she insulted an official of the Philippine Army (PA) at a checkpoint in Barangay Sirawan, Toril District in Davao City last month.
Charged with unjust vexation is Ann Umo-
quit, a barangay health worker (BHW), after he insulted the complainant Lt. Col. Nestor Monacho Mondia of the Task Force Davao (TFD) in Davao City.
Prosecutor Irene Joy TalaMontero found probable cause to charge the accused based on the complaint filed by Mondia.
In a resolution, the complainant attested that the accused entered the camp of the military in Sirawan on September 19 without passing through the main gate.
The complainant ordered a certain Sergeant (Sgt.) Fuentes to verify the purpose of the accused in entering the camp. Fuentes accompanied Umoquit to Mondia.
Mondia confronted Imoquit that visitors entering the camp should pass through the main gain for safety reasons. But the confrontation led to a heated altercation between the two parties.
The accused allegedly shouted and uttered filthy words against the complainant, which annoyed the latter, prompting them to ask for police assistance.
In a Supreme Court rule, the action of the accused is a common expression in the dialect that is often employed, not really to slander but rather to express anger of displeasure.
The accused was then brought to Toril Police Station for her proper disposition.
