2 charged with indirect assault

TWO men are facing charges before the court after they fought against a police auxiliary and a policeman at a resort in Matina Aplaya, Talomo District, Davao City on November 12, Sunday.

Charged with indirect assault or disobedien­ce to a person in authority or any other provision under the Revised Penal Code, are

Carl Lopez Aguinid and Armando Traso Maglangki, of the same area.

Prosecutor Delfin Suarez Jr. found probable cause to charge the accused based on the complaint filed by the victim, Roldan Francisco, a police auxiliary, with a supporting affidavit from PO2 Rey Escaro.

In a two-page resolution dated December 4, Francisco attested that the incident happened around 12:35 a.m. when he and Escaro were conducting patrol at the Bonguyan Resort in Matina Aplaya.

The authoritie­s were at the center of the resort when they noticed one in the group of men lighted a cigarette. The complainan­t approached the group and cautioned the one who lighted a cigarette.

But the two accused acted arrogantly and resisted. Aguinid pushed Francisco away, thus, Escaro ordered the arrest of Aguinid. But the latter with Maglangki resisted that resulted to a scuffle between the accused and the complainan­ts.

Francisco sustained soft tissue contusion on his left arm and abrasion on his right arm.
