2 charged with in­di­rect as­sault

TWO men are fac­ing charges be­fore the court af­ter they fought against a police aux­il­iary and a po­lice­man at a re­sort in Matina Aplaya, Talomo Dis­trict, Davao City on Novem­ber 12, Sun­day.

Charged with in­di­rect as­sault or dis­obe­di­ence to a per­son in author­ity or any other pro­vi­sion un­der the Re­vised Pe­nal Code, are

Carl Lopez Aguinid and Ar­mando Traso Maglangki, of the same area.

Pros­e­cu­tor Delfin Suarez Jr. found prob­a­ble cause to charge the ac­cused based on the com­plaint filed by the vic­tim, Roldan Fran­cisco, a police aux­il­iary, with a sup­port­ing af­fi­davit from PO2 Rey Es­caro.

In a two-page res­o­lu­tion dated De­cem­ber 4, Fran­cisco at­tested that the incident hap­pened around 12:35 a.m. when he and Es­caro were con­duct­ing pa­trol at the Bonguyan Re­sort in Matina Aplaya.

The au­thor­i­ties were at the cen­ter of the re­sort when they no­ticed one in the group of men lighted a cig­a­rette. The com­plainant ap­proached the group and cau­tioned the one who lighted a cig­a­rette.

But the two ac­cused acted ar­ro­gantly and re­sisted. Aguinid pushed Fran­cisco away, thus, Es­caro or­dered the ar­rest of Aguinid. But the lat­ter with Maglangki re­sisted that re­sulted to a scuf­fle be­tween the ac­cused and the com­plainants.

Fran­cisco sus­tained soft tis­sue con­tu­sion on his left arm and abra­sion on his right arm.
