Man sued for rape
A MAN is facing charges before the court after he raped a minor girl, who is his neighbor, in a barangay in Buhangin District, Davao City last month.
Charged with violation of the Republic Act 8353, otherwise known as AntiRape Law, in relation to Republic Act 7610 or AntiChild Abuse, is one Ruyo.
Prosecutor Jose Charito I. Cortez II found probable cause to charge the accused based on the complaint filed by victim Liza (not her real name).
The victim, in her affidavit, attested that Ruyo brought her to a house where she was choked, slapped and her head was banged to the wall.
She said the accused also pointed a knife at her then undressed her. He then proceeded kissing her and continued his personal motives towards her, she added.
Cortez made clarificatory questions and intro-
duced an anatomically correct diagram of a female body to inquire from the complainant what happened to her.
The mother of the victim, in a separate affidavit, attested that they were celebrating an event in their subdivision on December 3 when she noticed her daughter, who was just dancing at the gym with her friends, was already missing.
According to the mother, she only saw her daughter crying the following day. Her daughter told her everything after she questioned her what had happened. They immediately sought police assistance and the accused was arrested at his house.
In this case, attached are the supplemental affidavit of the mother of the victim, affidavit of apprehension, a Women and Children Protection Desk (WCPD) blotter, medical certificate of the complainant and her identification (ID) card.
The medical certificate of the complainant revealed that the victim has Down syndrome. The accused is currently detained at the Buhangin Police Station. ICT
