DTI asks court to reconsider ruling on 2 directives
MANILA -- The Department of Trade and Industry (DTI) said Friday it filed a motion for reconsideration on two Department Administrative Orders (DAOs) after the Makati Regional Trial Court ruled to impede the orders.
These DAOs involve DAO 05:2008, or the New Rules and Regulations Concerning the Issuance of Import Commodity Clearance (ICC) under the Products Specification Scheme of the Bureau of Product Standards (BPS), and the DAO 15-01 or the Measure to Facilitate the Issuance of ICC.
“The court’s ruling is not yet final and executory as the department has filed a motion for reconsideration to the Makati Regional Trial Court,” DTI Consumer Protection Group Assistant Secretary Ernesto Perez said.
The DAO 05:2008 prescribes rules and regulations on issuing ICC to import shipments covered by the mandatory BPS product certification.
On the other hand, the DAO 15-01 promotes ease of doing business by limiting the ICC processing time to three working days, without compromising product safety.
“The DTI-BPS maintains a status quo on implementing its product certification scheme on imported products to ensure that only safe and quality steel products are sold and distributed in the Philippine market,” said BPS Director-inCharge James Empeño.
“The bureau emphasizes that imported steel products are still subjected to the requirements of the relevant standards and must pass the various mechanical, chemical and physical tests,” added Empeño.
DTI advises manufacturers and importers to still follow the existing DAOs on the ICC issuance.
