Nepotismo
NIPASAKA og sumbong si Cebu City Councilor Pastor Alcover Jr. atubangan sa Office of the Ombudsman-Visayas mahitungod sa pagtudlo ni Cebu City Mayor Tomas Osmeña sa iyang kapikas, si Cebu City Councilor Margarita “Margot” Osmeña, nakalapas sa balaod nga nagdili sa nepotismo.
Unsa ba kining nepotismo? Ang Section 30, Republic Act 2260, nga giaprobahan niadtong June 19, 1959, nagkanayon, “(a) All appointments in the national, provincial, city and municipal governments or in any branch or instrumentality thereof, including government-owned or non-competitive service, made in favor of a relative of the appointing recommending authority, or of the chief of the bureau or office, or of the persons exercising immediately supervision over him, are hereby prohibited.
“As used in this section, the word “relative” and members of the family referred to are those related within the third degree either of consanguinity or affinity.”
Unsa man kining sud sa third degree of consanguinity? Kon ikaw mao ang appointing authority, magsugod kini kanimo, first degree ang imong ginikanan ug anak; second degree ang imong igsuon, apohan ug apo; ug third degree ang imong uyoan ug iyaan, pag-umangkon, great grandparent ug great grandchild.
Ang asawa nahimutang sa first degree of affinity, samtang second degree ang ugangan ug umagad.
Apan exempted sa lagda sa nepotismo kadtong mga tawo nga gipatrabaho sa usa ka confidential position, mga magtutudlo, mga doktor ug mga sakop sa Armadong Kusog sa Pilipinas.
Gidasonan ang maong balaod sa Sec. 59 (10, Subtitle A. Title 1, Book V, Administrative Code, nga nagkanayon, ‘Nepotism-(1) All appointments in the national, provincial, city and municipal governments or in any branch or instrumentality thereof, including government owned and controlled corporations, made in favor of a relative (within the third degree) of the appointing or recommending authority, or of the chief of the bureau or office, or of the persons exercising immediate supervision over him, are hereby prohibited.
‘As used in this Section, the word ‘relative’ and members of the family referred to are those related within the third degree either consanguinity or of affinity.”

Ang Korte Suprema (Civil Service Commission vs. Salas) niingon, ‘Every appointment implies confidence, but much more than ordinary confidence is reposed in the occupant of a position that is primarily confidential. The latter phrase denotes not only confidence in the aptitude of the appointee for the duties of the office but primarily close intimacy which ensures freedom of intercourse without embarrassment or freedom from misgivings of betrayals of personal trust or confidential of state.”
Unsa man ang silot sa nepotismo? Ubos sa Uniform Rules on Administrative Case in the Civil Service, Sec. 52, Rule IV, ang silot mao ang pagkatangtang sa serbisyo, lakip na sa pagkanselar sa iyang eligibility, forfeiture sa retirement benefits ug pagdiskwalipikar sa pagbalik sa pagtrabaho sa gobyerno.
