Pag-imbargo sa driver’s license

Gipasar sa miaging semana sa konseho sa syudad sa Sugbo, sa boto nga 9-6, ang usa ka ordinansa nga maghatag og gahum sa mga traffic enforcers sa pag-imbargo sa driver’s license niadtong mga drayber nga makalapas sa mga balaod sa trapiko.

Ang mga traffic enforcers mahimo lang nga mo-isyu og mga traffic citation tickets ngadto sa mga drayber nga nakalapas sa mga balaod sa trapiko. Apan dunay orden ehekutibo si Cebu City Mayor Tomas Osmena nga nagtugot sa pag-impound sa mga sakyanan nga masakpan nga nag-counterflow.

Apan di kaha magkasumpaki ang maong ordinansa ug ang Republic Act No. 4136, ang Land Transportation and Traffic Code of the Philippines? Ang mga batid sa balaod nag-ingon nga ang usa ka ordinansa di maka-amendar sa usa ka balaod nga gipasar sa Kongreso.

Ang Section 29 sa maong balaod nga naghisgot bahin sa pag-imbargo sa driver’s license, nagkanayon, “Law enforcement and peace officers duly designated by the Commissioner shall, in apprehending any driver for violations of this Act or of any regulations issued pursuant thereto, or of local traffic rules and regulations, confiscate the license of the driver concerned and issue a receipt prescribed and issued by the Commission therefor which shall authorize the driver to operate a motor vehicle for a period not exceeding seventy-two hours from the time and date of issue of said receipt. The period so fixed in the receipt shall not be extended, and shall become invalid thereafter. Failure of the driver to settle his case within fifteen days from the date of apprehension will cause suspension and revocation of his license.”

Ang LTO ug mga deputized agents niini maka-imbargo sa driver’s license niadtong nakalapas sa Traffic Code ug sa lokal nga mga ordinansa sa trapiko. Wa kini maghisgot sa mga traffic enforcers.
