DOLE sets pay rules for holiday workers
The Department of Labor and Employment (DOLE) has issued Labor Advisory No. 13 series of 2017 for the payment of wages on October 31and November 1 as special non-working holidays.
Pursuant to Proclamation No. 50 issued by President Rodrigo Duterte on August 16, 2016 declaring special nonworking days of the said dates for the traditional All Saint's Day commemorative activities, the following rules for pay on special days shall apply:
• If the employee did not work, the ‘no work, no pay' principle shall apply, unless there is a favorable company policy, practice or collective bargaining agreement granting payment on special days.
• For work done, an employee shall be paid an additional 30 percent of his daily rate on the first eight hours or [(Daily Rate x 130%) + COLA].
• While for work done in excess of eight hours (overtime), he/she shall be paid an additional 30 percent of his hourly rate or [(Hourly Rate of the basic daily wage x 130% x 130% x number of hours worked)].
• For work done during these days that also fall on employee's rest day, he/she shall be paid an additional 50 percent of his/her daily rate on the first eight hours, or [(Daily Rate x 150%) + COLA].
• While for work done in excess of eight hours (overtime), he/she shall be paid an additional 30 percent of his hourly rate, or [(Hourly Rate of the basic daily wage x 150% x 130% x number of hours worked)].
DOLE Secretary Silvestre Bello III issued the advisor last Oct. 27.
