Woman charged for hurting teen

Complainan­t, whose name is being withheld by The FREEMAN to protect the victim's identity, alleged Donessa Gomez, a resident of Barangay Mambaling, Cebu City, pushed and attacked her.

The victim reportedly suffered abrasion in her face, nape, and forearm, prompting her to file physical injuries in relation to Republic Act 7610 or the AntiChild Abuse Law against Gomez.

Prosecutor IV Maria There's Calibugan-Casiño charged Gomez with slight physical injuries.

"On review, we find that there exists no probable cause to indict respondent with the crime as charge. The proper charge for the offense committed is slight physical injuries and not physical injuries in relation to Republic Act 7610 as charged," reads the decision.

Casiño said there was no showing that the act complained of was committed purposely to cause any physical harm as defined under the law of RA 7610.

In her complaint, the teenager said she confronted Gomez after hearing that the latter was allegedly mad at her for betraying her younger sister, who is the former’s childhood best friend.

But Gomez allegedly denied the issue and pushed her hard.

When she was about to go home, Gomez allegedly attacked her.

Casiño issued a subpoena directed Gomez to file her counter-affidavit to answer the allegation­s filed against her, but failed.

Thus, Casiño resolved the complaint based on the evidence available and found probable cause to elevate the case of slight physical injuries to the court.
