Boniel now in CPDRC

Bohol Board Member Niño Rey Boniel, one of those accused in the killing of his wife, a former mayor of Bien Unido, Bohol, is now detained at the Cebu Provincial Detention and Rehabilita­tion Center two months after the issuance of the order of the Supreme Court en banc.

The Supreme Court partially granted the letter-request of Justice Secretary Vitaliano Aguirre II to consolidat­e the cases and transfer the venue of the trial of kidnapping and serious illegal detention of Niño Rey, and suspects Wilfredo Hoylar and Restituto Magoncia Jr. from Regional Trial Court Branch 52 in Talibon, Bohol, to Cebu City RTC.

In his petition, Aguirre alleged there were reports of “continuing attempts to influence the local police and jail officials in order to give special treatment” to Niño Rey at the Talibon District Jail.

The SC granted the transfer the venue of the trial but ordered a separate raffle for the kidnapping and serious illegal detention case.

Niño Rey is facing a parricide case, while Hoylar, Magoncia, and other suspects Riolito Boniel, Randel Lupas, Allan Delos Reyes Jr., and Lobo Boniel are facing a murder case. They were charged for alleged conspiracy in the killing of Niño Rey’s wife, Gisela, on June 7, 2017.

Gisela was allegedly shot in the head and wrapped in a fishnet weighed down with rocks before she was thrown into the sea between Caubian Island and Olango Island in Lapu-Lapu City.

Amando Virgil Ligutan, legal counsel for the family of Gisela and private complainan­t Angela Leyson, confirmed that on January 8, 2018 the presiding judge of RTC Branch 52 issued the commitment order for the immediate transfer of Niño Rey and two others from the Talibon District Jail to CPDRC.

The Bureau of Jail Management and Penology in Talibon received the order of the court on January 10.

Gerardo Carillo, one of the legal counsels of Niño Rey, said at 1:55 p.m. yesterday their client was transferre­d to CPDRC. He was there to assist Niño Rey for the profiling and interview. The mother and sibling of Niño Rey were also there.

So far, he said Niño Rey was fine at CPDRC. He added it was convenient for their part for the cases to be transferre­d to Cebu.

CPDRC acting jail warden Audesti Miguel assured that there will be no special treatment to be given to the board member. Boniel was detained in a regular cell of CPDRC.
