Italian faces theft for stealing hotel furniture, appliances

An Italian national is facing charges before the court for allegedly stealing valuable items from the room of a Cebu City hotel where he checked in April last year.

Prosecutor II Misty Leah Escolar-Hupp held Nana Marvin Savan D'avola, 30, temporaril­y residing in Upper Kawayan, B. Rodriguez St., Barangay Sambag 2, Cebu City for trial after finding probable cause of theft.

"...accused was given a chance to submit controvert­ing evidence, that on the basis of the evidence presented, there is a reasonable ground to believe that the crime of theft has been committed and that the accused is probably guilty thereof," she stated.

Hupp recommende­d P28,000 bail for the foreigner's temporary liberty.

In her complaint, Concepcion Jumapit, the hotel's representa­tive, alleged that on April 1, 2017, said the accused checked in at their hotel located on Juana Osmeña St., Kamputhaw, Cebu City in the name of Shoan Antonio Andales and George Michael Lucas.

For several times, she said, the accused went out of the hotel carrying big bags.

The management did not suspect that the big bags contained valuable items from the room of the hotel.

The theft was discovered on April 3, 2017 when a hotel employee checked the room of the accused. They reported the matter before the police.

The missing items were one unit of emergency light, two units of Skyworth TV, three pieces of pillow cases, two bath towels, five pieces of hangers, comfort room mirror, wi-fi router, electric kettle, one piece of double lock, three glass cabinets, and one side table with glass amounting to P65,860.

On August 27, 2017, they were informed that two foreign nationals were arrested and hotel employees positively identified that one of the foreigners was their guest.

Hupp subpoenaed the accused to submit his counter-affidavit to answer the allegation­s filed against him but he failed. Thus, Hupp resolved the complaint based on the evidence available.

"Theft is taking of personal property belonging to another without the latter's consent with intent to gain but without the use of violence against or intimidati­on of persons or force upon things. In this case, all the essential elements of the crime of theft are present," read the resolution.
