ALA files complaint vs Magsayo
The ALA Sports Promotions International (ASPI) has lodged a formal complaint before the Games and Amusements Board (GAB) Central Office in Manila against its estranged boxer Jessel Mark Magsayo in the hope of settling their contractual dispute.
Through its legal counsel Atty. Sonny Mercado, ASPI is asking the GAB, sitting as mediator as written in the contract, to render a ruling that a valid contract exists between the two parties, and that Magsayo is bound to honor it with sanction imposed for breach thereof.
In its seven-page complaint lodged before the GAB last June 20, ASPI respectfully prays that a resolution be issued in the instant arbitration proceeding finding that:
1.Per contract, a valid promoter-boxer contractual relation exists between JMM and ASPI, and that both parties are bound to abide with and follow the agreed terms and conditions; and
2.JMM did willfully violate the contract with ASPI for engaging the services of another promoter which, at the Honorable Board’s discretion, should warrant suspension or revocation of his license, and in either case, be directed to cease and desist from participating in any bouts (local or foreign) without ASPI’s consent.
The contractual rift between ALA and Magsayo broke out after Ryan Songalia of RingTv.com reported that the 22-year-old Magsayo has signed a contract with Malaysia-based manager Vikram Sivapragasam.
Magsayo's move shook ALA Boxing, with ALA Promotions President and CEO Michael Aldeguer swiftly admonishing the Tagbilaran City pugilist to honor his promotional contract with ALA to avoid complications that could affect his fistic career.
Aldeguer made it clear that Magsayo still has a live four-year promotional contract with them and that the one that has expired is the managerial contract.
"All I can say is that in 2017, Mark was given the chance to be the main event for two Pinoy Prides in just one year plus his dream of fighting in his hometown of Bohol last November. If there was no existing promotional contract, why would ALA Promotions invest in building him up more? That's the logic behind everything," explained Aldeguer.
However, Magsayo, the reigning WBO International featherweight champion, insisted that both his managerial and promotional contracts with ALA Promotions have already expired.
Magsayo though did not present any documents or material proof to support his claim. He did not respond when sought for comment on the case filed against him by ASPI.
