Court clears Lim scion in road rage shooting

The failure of the private complainan­t to attend court hearings has prompted the Regional Trial Court in Cebu City to dismiss the criminal case for frustrated homicide against the accused in a road rage shooting over a year ago.

RTC Branch 5 Judge Ricky Jones Macabaya dismissed the case against David Lim Jr., nephew of the controvers­ial businessma­n Peter Lim, after complainan­t Ephraim Nuñal did not anymore attend the hearings.

Nuñal, 33, a registered nurse, has already migrated to the United States with his entire family. Nuñal, resident of P. Cañezares St., Barangay Dumlog, Talisay City, earlier accused Lim of shooting him at the height of their traffic altercatio­n, hitting him in the right ankle and left thigh.

The incident happened on March 19, 2017 along F. Sotto Street in Barangay Kamputhaw, Cebu City. A separate case for illegal possession of ammunition against Lim is still pending before the RTC Branch 9.—
