Man indicted for 'stabbing' uncle

The Office of the Cebu City Prosecutor has charged a 36-year-old man before the court for allegedly stabbing his uncle, whom he accused of pilfering electricit­y.

Prosecutor II Ma. Liza Jorda held Rodulfo Sancho Jr., alias Bulldog, a resident of Sitio BSJCO, Barangay T. Padilla in Cebu City, for trial after finding probable cause for frustrated homicide.

“An examinatio­n of the facts shows that the essential elements in the crime of frustrated homicide is present in as much as the acts tending to the realizatio­n of the intention to kill in this case, consisted in the infliction of physical injuries on the complainan­t, and because of the timely medical interventi­on that prevented his death,” the resolution read.

Pedrito Capuyan, in his affidavit, said while he was having a drinking session with his friends and neighbors in front of their chapel on November 17, 2017, Sancho suddenly appeared and approached him furiously accusing him of illegally tapping their electrical connection.

A heated argument ensued between the two.

But when Capuyan noticed that Sancho was carrying a bladed weapon, the former ran away towards a nearby vacant lot.

Sancho’s mother meddled in the altercatio­n, but failed.

The mother reportedly handed over a kitchen knife to Capuyan.

Sancho followed Capuyan and attacked the latter who kept on parrying to avoid getting hit.

Unfortunat­ely, Sacho managed to stab Capuyan several times.

Sancho immediatel­y escaped the crime scene, leaving Capuyan bleeding on the vacant lot.

The victim's drinking buddies rushed him to the hospital. Capuyan survived.

Sancho was directed to submit counter-affidavit and other controvert­ing evidence, but failed.

Thus, Jorda resolved the complaint based on the evidence available and found probable cause to indict Sancho before the court.

Jorda recommende­d P24,000 bail for Sancho’s temporary liberty while the case is pending before the court.
