TO: The GENERAL PUBLIC WHEREAS, A Final Judgment in favor of plaintiff, BAUTISTA CAYMAN ASSET COMPANY, now substitute­d by Bautista REO PR Corp. (“Bautista”) was entered on June 15, 2018, pursuant to certain Stipulatio­n for the Entry of Judgment filed by the parties on May 22, 2018. WHEREAS, pursuant to the Stipulatio­n for the Entry of Judgment, Defendants owe jointly and severally to Bautista: for the Loan Agreement I, as defined in the Complaint, the total amount $4,390,538.50, which is composed of $2,903,111.16 in principal, and $1,445,346.14 in accrued interests, plus the amount of $504.01 per diem for interest; for the Loan Agreement II, as defined in the Complaint, the total amount of $15,533,104.72, which is composed of $10,993,968.00 in principal, and $4,521,194.32 in accrued interests, plus the amount of $1,908.68 per diem for interest; for the Loan Agreement III, as defined in the Complaint, the total amount of $1,418,196.81, which is composed of $948,385.00 in principal, and $431,456.37 in accrued interests, plus the amount of $217.34 per diem for interest; for the Loan Agreement IV, as defined in the Complaint, the total amount of $12,378,519.34, which is composed of $8,744,239.62 in principal, and $3,611,023.61 in accrued interest, plus the amount of $1,518/10 per diem for interest; for the Loan Agreement V, as defined in the Complaint, the total amount of $829,899.89, which is composed of $644,794.60 in principal, and $181,069.38 in accrued interests, plus the amount of $76.12 per diem for interest, but not including, among other, legal expenses. WHEREAS, on January 22, 2021, Bautista filed a Motion for Partial Execution of Judgment, whereby it requested the execution of certain collateral related in the Complaint, as partial satisfacti­on of the outstandin­g balances agreed to in the Stipulatio­n for the Entry of Judgment. WHEREAS, on January 27, 2021, this Court entered an Order of Public Sale in Partial Execution of Judgment (Docket No. 124) and issued the correspond­ing Writ of Execution on January 28, 2021, (Docket No. 125), granting Bautista’s Motion for Partial Execution of Judgment and allowing the public sale of the Properties (as defined below). WHEREAS, pursuant to the aforementi­oned Judgment, the Order of Public Sale and Partial Execution of Judgment entered on January 27, 2021, and the Writ of Execution issued on January 28, 2021, the undersigne­d was ordered to sell at public auction, for U.S. currency in cash or certified check without appraiseme­nt or right of redemption to the highest bidder and at the Clerk’s Office of the United States District Court for the District of Puerto Rico, or at any suitable place that the undersigne­d may designate for those purposes, to cover, to the extent possible, the sums adjudged to be paid to Bautista, the following real properties (the “Properties”) belonging to and recorded in the name of Mora Developmen­t Corporatio­n. The Properties are recorded at the Registry of Property of Puerto Rico as: i. Real Property 14,828: -----RUSTIC: Parcel of land, located in the Cibuco Ward, of the Municipali­ty of Corozal, Puerto Rico, with a Surface area of 37.7716 cuerdas, equivalent to 148,457.41 square meters. Bordering on the NORTH, with Arcelio J. Bou, María Nieves, Marí R. Bou, and Juan Bou; on the SOUTH, with the parcel from which it was segregated; on the EAST, with the Cibuco River; and on the WEST, with State Road Number 818----Property Number 14,828, recorded at page 138 of tome 295 of Corozal, Registry of Property of Puerto Rico, Barranquit­as Section.- ii. Real Property 59,538: -----RUSTIC: Parcel of land located in the Martín González and San Antón Wards of the Municipali­ty of Carolina, Puerto Rico, identified in the plan as PARCEL E with a surface area of ELEVEN THOUSAND SEVEN HUNDRED FORTY-SEVEN POINT FIVE HUNDRED FIFTY-TWO (11,747.552) square meters, equivalent to TWO POINT NINE HUNDRED EIGHTY-NINE (2.989) CUERDAS, bordering on the NORTH, with lands property of Rafael Ramos Cobián separated by the Blasina Brook; on the SOUTH, with a municipal road; and on the EAST, with the parcel identified in the plan as “Future Route 66,” and on the WEST, with state road number PR eight hundred eighty-seven (PR-887).-- It is segregatio­n from property number 9148, recorded at page 210 of tome 1194 of Carolina II, the segregatio­n presented at entry 51 of the Book of Daily Entries 318, Carolina II The Property is recorded at page 139 of volume 1,441 of Carolina, Property #59,538, Registry of Property of Puerto Rico, Section II of Carolina.

The mortgages that encumber the Properties that will be executed through the public sales are the following: Real Property 14,828 i. Mortgage payable to the order of Doral Financial Corp., or to its order, in the principal amount of $1,010,000.00 with annual interests of 15%, due on demand, secured by a mortgage constitute­d pursuant to the terms of Deed of Mortgage Number 90 executed on October 9, 2001 before Notary Public Francisco Pujol Meneses, recorded in the Registry of the Property of Puerto Rico, Section of Barranquit­as at page 139 of volume 295 of Corozal. This Mortgage was later increased to the amount of $1,185,000.00, pursuant to Deed of Mortgage Number 37, executed on July 3, 2002 before Notary Public Manuel Correa Calzada, at page 139 of volume 295 of Corozal. (the “Mortgage I”). Real Property 59,538 ii. Mortgage executed by and between Mora and Doral Financial Corp. on August 18, 2003, before Notary Public Carlos M. Garcia Rullán, in the principal amount of $800,000.00, constitute­d by Deed Number 39, executed on San Juan, Puerto Rico, on August 18, 2003 before Notary Public Carlos M. García Rullán, recorded in the Registry of the Property, Section II of Carolina, at page 144 of volume 1,441 of Carolina (the “Mortgage II”). The Properties are subject to the following liens and attachment­s: Real Property 14,828: i. Notice of Complaint filed by Bautista Cayman Asset Company related to the instant case. Real Property 59,538: i. Notice of Complaint filed by Bautista Cayman Asset Company related to the instant case. WHEREAS, Real Property 59,538 is subject to the following prior liens (i) Easement in favor of the Puerto Rico Electric and Power Authority; (ii) Easement in favor of Finca de Santiago Bayron Biascoeche­a; (iii) Easement in favor of the Commonweal­th of Puerto Rico; (iv) Easement in favor of Central Victoria, Inc.; Easement in favor of the United States of America. WHEREAS, all the bidders attending each of the public sales will accept as correct and sufficient the rights and titles previously described and listed as prior liens to the Properties.
