Agency response to lease cancellati­on ‘unethical’

I HAVE been trying to get my issue resolved with an estate agency in Mossel Bay since I gave three months’ notice for the cancellati­on of my paidup lease on June 26.

Twenty days is accepted by law, and the agency deemed at fault if a replacemen­t tenant is not found. I placed an ad, and sent a respondent to the agency, but nothing transpired.

Initially I was ignored, then they tried to get me to leave the premises in 72 hours as they might have a tenant, with no guarantee of refunding my rent.

I have been advised by the Western Cape Housing Tribunal that my case may be premature. They said I would most likely have to vacate the premises and then reinstate the case.

However, in the same breath I am told it is unlikely I will be reimbursed.

Based on the way I have been treated thus far, I cannot risk moving out and losing my investment.

It is now three months later and the agents are not doing anything proactive to secure a new tenant or offer a reasonable penalty fee.

It is blatant fraud, unethical and unprofessi­onal.

They have also said they will do nothing until I have gone to the housing tribunal, knowing the tribunal may say the case is premature.

This all because they have my paidup rent.

Corrupt business practices like these are destroying this country and investment­s.

I had to cancel my lease for a scarce work opportunit­y. I needed the cash to secure my accommodat­ion and flights. I have subsequent­ly lost that job and have zero prospects here.

The owner of this property has told me his monthly expenses are too high and he is not refunding me.

The agency’s “customer care” service has told me they’re not at fault because they are following the landlord’s decision.
