ANCYL court case struck from the roll

DISGRUNTLE­D ANC Western Cape Youth League (ANCYL) activists received a bloody nose in court when their case to challenge the legitimacy of the body was struck off the roll.

Western Cape High Court Judge Hayley Slingers ruled that the group’s applicatio­n to nullify the regional congresses of the ANCYL was not an urgent matter.

Luvuyo Mpofu, one of the disgruntle­d members, said they were disappoint­ed with the ruling and believed that Judge Slingers had too little time to consider the case.

“We will now seek legal opinion on whether we should appeal the case or not,” he said.

The group wanted a provincial congress to be held as they believe that the current leadership was illegitima­te.

According to section 6 of the ANCYL’s constituti­on, a provincial executive committee (PEC) should be elected three months after its term ends. The PEC’s term ended around February. The applicants also sought to nullify congresses that took place in the Karoo and Southern Cape two weeks ago. The group alleges that the congresses are being rushed through without the consent or knowledge of the branches in order to organise a provincial congress that would see the current leadership re-elected. The ruling does not stop the group from launching another appeal on the matter.

Advocate Adrian Montzinger, legal representa­tive for the current PEC, argued that the matter was not urgent.

It was also argued that a provincial congress will be held next month. Previously they have also argued that the disgruntle­d members, issued a press statement wherein they expressed concerns about the alleged illegitima­te status of the PEC.

Andile Mbali, provincial secretary of the ANCYL, said after having held three successful regional congresses, namely Southern Cape, Central Karoo and Cape Metro (Dullah Omar) and Boland regions branches elected regional executive committees and crafted regional political programmes.
