Murder accused now charged for sex assault

A SECOND case, this time the sexual assault of a 5-year-old girl, has been opened against Bongani Dlamini, who is currently on trial for the murder of little Anovuyo Ndamase, a case which rocked the community at Enkanini informal settlement.

Dlamini made his second appearance in the Khayelitsh­a Magistrate’s Court yesterday, where he is being charged with the kidnapping and murder of Anovuyo, also a 5-year-old girl. Chaos ensued outside the courtroom as police held back angry residents who attempted to force their way inside.

It was heard that another case of sexual assault had been opened as State prosecutor Manelisi Macaba told the court Dlamini had allegedly given the young girl grapes and “touched her private parts”.

Macaba said the young girl’s mother had looked for her and had asked Dlamini if she was in his shack.

Although he denied that the girl was with him, Macaba said her mother opened his door and found the girl inside his home.

Macaba said the State was still to consult with the victim and gather a statement from her father.

This came after more details linking Dlamini to Anovuyo’s death emerged.

Her body was found stuffed in a refuse bag earlier this month, just 20m from her home in Enkanini. She had gone missing five days earlier.

Macaba said while a postmortem revealed that Anovuyo died from blunt-force trauma to the head, her DNA was also found on a hammer.

Macaba said blood found on the walls, floors and bedding of Dlamini’s home all matched that of the deceased.

He said chewing gum stuck on her body was also found to contain Dlamini’s DNA.

Both matters have been postponed to May 27 for further investigat­ion. The court heard that Dlamini would not proceed with a bail applicatio­n.

As Dlamini left the courtroom, he sighed and glanced at those in attendance.

Outside court, a group of about 100 angry residents protested against Dlamini receiving bail.

South African National Civics Organisati­on chairperso­n Ayanda Tetani said the community was even more angry after hearing of the second case against Dlamini.

“We don’t want something like this to happen in our community. Living in an informal settlement, things like this happen most of the time,” he said.

Tetani said the community would be happy only once a lengthy sentence was handed down to Dlamini, but was satisfied that time was taken for the State to gather evidence.

He added that Anovuyo was buried in the Transkei last weekend.

“We just heard now what he has done to another girl,” said Fuziswa Mtshanqu, of the Prevention in Action campaign.
