Jam-Jam accused ‘is sick and needs operation’

- Sandiso Phaliso

ONE of the two men charged with the murder of Khayelitsha woman Aviwe Jam-Jam is sick and needs medical attention, according to the pair’s lawyer, David Mbazwana.

But accused Leroy Morris won’t get any medical attention because Pollsmoor prison is not capable of providing it, Mbazwana told the Athlone Magistrate’s Court.

Jam-Jam went missing from boyfriend Linda Ntulo’s home on July 22. Her bruised body was discovered a week later at the Vygieskraal stadium. Morris and Ntulo are accused of her murder.

Morris has an appendicitis and needs surgery performed by a doctor from outside the prison.

“He has been suffering from stomach pains. The only thing they gave him are tablets. The tablets are ineffective. He will have to have an operation,” Mbazwana told magistrate Keith le Keur.

The case has been postponed to October 3 for bail applications.

Protesting against the postponement, Mbazwana told Le Keur that the case should be dealt with as soon as possible.

Mbazwana was unhappy after prosecutor Nangamso Matta told Le Keur the State was not able to continue with the bail application because the prosecutor meant to handle the matter would not be ready until September 29.

Matta said the prosecutor claimed the case had not been allocated to him in time, and he was not prepared.

Outside court Mbazwana said: “Mr Morris is not well, he is sick and he’s been complaining in Pollsmoor of his sickness.

“They took him to the hospital section but they are giving him pain tablets, and it is not helping.

“They informed him in Pollsmoor that the only thing that can help is to perform an operation to remove his appendix, but they cannot help him in Pollsmoor and advised him to bring a bail application and undergo surgery outside prison.

“He knows what the cause of his illness is and he knows what can be done to prevent the pain he is suffering from.”

Ntulo separately faces another charge of the attempted murder of Jam-jam’s stepfather, Mike Mguga.

On Tuesday, Ntulo’s attempted murder case was postponed until September 27 because Mbazwana was absent. Ntulo has been in custody for almost a month now.
