Later, however, the hunters brought a high court applicatio­n claiming the evidence was unlawfully obtained via a “warrantles­s search”. Was the interactio­n at the crossing a “search”, or were the carcasses “in plain sight”, simply requiring torchlight?

It was a crucial distinctio­n: if the court found that the evidence resulted from an unlawful search, the case against the hunters would surely have to be dropped.
