‘Lawyer not giving me my money’

R2.4m road fund payout said to be in trust account

A Pretoria attorney is accused of blocking a client’s cellphone calls after persistent inquiries about nonpayment of a Road Accident Fund (RAF) compensati­on.

As a result, Tsepiso Mosibi has to depend on his family’s support although he has R2.4million sitting in the attorney’s trust account.

Mosibi, 35, of Kuruman, Northern Cape, was involved in a road accident which left him with a head injury in 2009.

He was on his way – hitchhikin­g – to visit a friend in Bathlorosi village when he had the accident. Mosibi did not reach his destinatio­n and woke up a few weeks later in hospital.

He had been in a coma due to the severity of his injuries. He also suffered multiple fractures to his ribs and left leg.

When Mosibi was discharged from hospital, he was approached by a neighbour who referred him to Molema Mampuru Inc Attorneys.

With the help of his family, they travelled to Pretoria to meet with the attorney to lodge a RAF claim. The firm got R2.4-million compensati­on paid into its trust account in September 2014.

Mosibi said that to date he has not received a cent.

Mosibi said he was also dissatisfi­ed about the manner in which Mampuru handled the final court hearing in 2015.

“He invited us to the Pretoria High Court, never bothered to meet us, and instead sent a woman we did not know to tell us that he had won the case.”

His relative Pule Boraki said they later discovered that Rose Nonyane of Nonyane Inc was appointed curator bonis to administer Mosibi’s affairs.

He said they had not been able to get monthly payments for Mosibi’s daily needs because Mampuru has not released the compensati­on into the curator’s account.

Mampuru said he has been depositing R4500 into Mosibi’s account since February this year and also bought land for him. He said he also bought a computer for Mosibi’s adoptive daughter.

Mampuru accepted that this was the curator’s duties but said he could not transfer Mosibi’s compensati­on into Nonyane’s account because she was reluctant to give him her bank account number.

“This has been a stressful matter and I’m glad I will extricate myself today as soon as I transfer his money to Nonyane’s account,” he said.

Nonyane confirmed she was appointed curator bonis to take care of Mosibi’s daily needs, shelter and maintenanc­e, but had not received a cent.
