SA designer tackles retailer for copyright infringement
Well-known internationally acclaimed South African designer Laduma of MaXhosa has filed a legal copyright dispute with fashion retailing store Zara regarding the use of his trademarked pattern used in his 2014 Mercedes-Benz AFI fashion show.
Having heard from loyal supporters and clients of the design house, head designer of MaXhosa, Laduma was made aware of the infringement – outlined in a media release sent out on Twitter – stating: “Earlier this month (April 2018), we were alerted by our patrons, that Zara company has copied one of our signature patterns.
“These patterns were appropriated and reproduced as part of their sock range which they shared as new in their best sellers on their online store.”
They went on to explain the depth of the infringement by the well-known retailer.
“Their sock range resembles our Khanyisa Cardigan which was launch in March 2014 at the Mercedes-Benz Fashion Week Joburg.
“The cardigan is still available on our online store and has been on runways globally.
“The piece is still one of our best sellers.”
Laduma has sought the legal services of Shane Moore and Muhammad Patel from Moore Attorneys, which is among the leading trademark and brand protection law firms on the continent.
Gaining the support of fans, government and the private sector, the Proudly South African organisation has joined forces in solidarity with the designer.
With the infringement having just been filed, the case is still awaiting judgment. –
