Probe into ‘abuse of power’

Special Investigat­ive Unit (SIU) head, Advocate Andy Mothibi, must be urgently investigat­ed by the justice ministry for alleged abuse of power, according to recommenda­tions made by the justice and correction­al services committee.

Mothibi confirmed he was aware of the committee’s intention to have him investigat­ed, but not of details of the allegation­s themselves.

“I am not aware of the content of what has been referred to, so until it is brought to my attention I cannot comment further,” he said.

Mothibi confirmed that while the presidency could instruct the unit to initiate investigat­ions, in terms of the law, his unit fell under the jurisdicti­on of Justice Minister Ronald Lamola, who was the only one who could investigat­e and discipline him.

But Mothibi said he had yet to be notified of an investigat­ion and until it was brought to his attention, he would continue with his work.

This followed the committee receiving a letter of complaint against Mothibi’s management style regarding a “gross abuse of power and abuse of SIU resources to conceal sexual harassment tendencies and the victimisat­ion of women employees”.

Committee chairperso­n, Bulelani Magwanishe, said the matter would be referred to Lamola yesterday.

“We will inform the minister that the matter is very urgent and that there should be an expeditiou­s investigat­ion. Furthermor­e, we would require a report on this matter when we return to parliament early in the new year,” said Mr Magwanishe.

“The SIU is very important in the fight against corruption.”
