He said a debtor might now have to be present when creditors apply for an EAO. “Should a debtor be of the view that the process has not been followed, in that the EAO has been granted without judicial oversight, they may approach our offices to investigate or seek an attorney to assist in approaching a court to address the issue,” Lala-Mohan said.

However, he said the ruling would only apply to EAOs granted after the judgement.
