Van Breda ruling due

JUDGE Siraj Desai was due to rule this morning whether the initial statement that murder accused Henri van Breda made to police can be admitted as evidence.

Judge Desai listened as the State and the defence presented their closing arguments in the trial-within-a-trial regarding its admissibility.

The State argued that Henri was not seen as a suspect at the time, and that at the time of making the statement, he was not detained or arrested.

The defence said Henri was seen as a suspect when he was questioned by police. The failure by police to inform Van Breda of this renders the statement and the contents of it inadmissible, it said. – Staff Reporter
