Van Breda rul­ing due

JUDGE Si­raj De­sai was due to rule this morn­ing whether the ini­tial state­ment that mur­der ac­cused Henri van Breda made to po­lice can be ad­mit­ted as ev­i­dence.

Judge De­sai lis­tened as the State and the de­fence pre­sented their clos­ing ar­gu­ments in the trial-within-a-trial re­gard­ing its ad­mis­si­bil­ity.

The State ar­gued that Henri was not seen as a sus­pect at the time, and that at the time of mak­ing the state­ment, he was not de­tained or ar­rested.

The de­fence said Henri was seen as a sus­pect when he was ques­tioned by po­lice. The fail­ure by po­lice to in­form Van Breda of this ren­ders the state­ment and the con­tents of it in­ad­mis­si­ble, it said. – Staff Re­porter
