Kagiso is now 9 years old and totally dependent on others for his daily functionin­g.

According to the nurses, the mother was squatting on the floor when she gave birth. It was thus unlikely that Kagiso suffered brain injuries due to falling on his head. The court heard that the delivery took about two minutes.

The mother said she was placed on the bed after the nurses left the room. While her buttocks were on the edge of the bed, the baby suddenly appeared and fell onto the floor.

Molefe said she noticed only after a month that something was wrong with Kagiso. Hewas unable to use his left arm, which twitched.

A doctor who examined the baby found no injuries.

Judge AC Basson said the fact that Kagiso suffered injuries only to the right side of his brain indicated that he did fall from the bed on the side of his head.

The weight of the baby and the height of the bed from which he fell all contribute­d to the severity of his injuries.

“Had the nurses been present and not negligentl­y in breach of their duty, they would have assisted the mother in the delivery process and would have prevented Kagiso from falling,” the judge said.
