Is it better to be United or Unitary?

United usually means “joined together as a group.”

In the case of the United States, the Constituti­on establishe­s federalism as the sharing of powers between the U. S. federal government and the individual state government­s. Here united states mean having a liberal and federal government. While each of the 50 U.S. states has its own constituti­on, all provisions of the states’ constituti­ons must comply with the U.S. Constituti­on.

The states draw their powers under our system of federalism from the Tenth Amendment of the Constituti­on, wh i ch grants them all powers not specifical­ly granted to the federal government, nor forbidden to them by the Constituti­on.

For example, while the Constituti­on grants the federal government the power to levy taxes, state and local government­s may also levy taxes, because the Constituti­on does not prohibit them from doing so. In general, state government­s have the power to regulate issues of local concern, such as drivers’ licenses, public school policy, and non-federal road constructi­on and maintenanc­e.

Unitary can be perceived in different ways. Unitary means “forming a single or uniform entity” or “relates to a system of government or organizati­on in which the powers of the constituen­t parts are vested in a central body.”

A unitary system of government, or unitary state, is a sovereign state governed as a single entity. The central government is supreme, and the administra­tive divisions exercise only powers that the central government has delegated to them. Sub divisional units are created and abolished, and their powers may be broadened and narrowed by the central government. The United Kingdom, for example, is a unitary state, as its constituen­t countries — England, Scotland, Wales, and Northern Ireland — have no power to challenge the constituti­onality of acts of Parliament.

Court System

State courts are courts of “general jurisdicti­on”. They hear all the cases not specifical­ly selected for federal courts. Just as the federal courts interpret federal laws, state courts interpret state laws. Each state gets to make and interpret its own laws. This helps the states retain power, and makes sure that the national government does not become too strong.

As per the Constituti­on, U.S citizens feared that the federal courts might threaten the independen­ce of the states and the people. To combat this fear the framers set up a federal court system that can only hear cases in special circumstan­ces. We call this having “limited jurisdicti­on.” Since the federal courts can only hear certain kinds of cases, most of the day- to- day cases that courts deal with happen in state courts.

Basically, federal courts hear only 2 types of cases; those that raise a “federal question” and those involving “diversity of citizenshi­p”.

Think a minute
