Man jailed for selling damaged used car
abu dhabi — A motorist, who was convicted of intentionally selling a used car with technical defects to another person, has been jailed for two months.
The Federal Supreme Court in Abu Dhabi upheld earlier rulings by the lower courts that handed down the sentence to the Asian man, after he was found guilty of defrauding another person by selling him a damaged car that was no longer allowed on the roads.
Official court documents stated that the victim had filed a complaint to the authorities after the car failed to pass the inspection test.
The car had defects in the body chassis and the registration was rejected by the traffic authorities.
The complainant had bought the vehicle from the defendant residing in a northern emirate at Dh6,700, who had told him that the car had minor mechanical problems which can be easily fixed.
The vehicle failed when taken for inspection test to transfer its registration licence. The inspection technician told the man that the car had major faults in the body chassis caused by rusting and that it would not be allowed to register because it wasn’t safe.
Prosecutors charged the defendant with commercial fraud and cheating another person by selling him a car with major technical defects. He had denied the charges claiming that the car only had minor mechanical faults and that he wasn’t aware of the defects in its chassis.
Both the first instance court and the appeal court found the man guilty of the charge and gave him two months jail followed by deportation.
The defendant challenged the rulings of the UAE’s top court which has maintained earlier rulings.
He will be deported after serving his jail sentence.
