Man contests court ruling to pay Dh275k to ex-wife

ras al khaimah — The Ras Al Khaimah Personal Status Court of Appeal started hearing a case in which an Asian man has been ordered by a lower court to pay Dh275,000 to his ex-wife and two children.

As per court records, the case unfolded when the plaintiff, an Arab woman, filed a lawsuit against her husband seeking divorce for ill treatment, as well as repeated physical and emotional abuse.

The Personal Status Court of First Instance ruled in favour of the woman, and ordered her husband in August to pay the said amount that included regular expenses, house rent, and deferred dowry.

The woman was also given the custody of her two children, and her husband was ordered to pay her a monthly maintenance.

The plaintiff told the court that her husband used to beat her up, and refused to support her and her two kids.

“I could not help renting another house and furnishing it at my own expense,” she told the court. “I also had to hire a housemaid, and pay school fees for my children after my husband abandoned us.”

She added that her former husband is well-off and has an investment apartment. “He refused to settle the family dispute in an amicable way at the counselling committee of the RAK courts.”

Therefore, she sought divorce for harm and damage, and requested the court to order her husband to pay due entitlements as per the Sharia law.

The man, in response, said he could not provide house for his wife and children because he was on a visit visa, and does not have a job.

The court, having heard the witnesses, and lawyers’ pleadings, ordered irrevocable divorce, while the defendant husband was ordered to pay a Dh1,000 against deferred dowry, Dh1,000 as maternal allowance, and Dh75,000 against house rent, children expenses, and school fees.

The husband, dissatisfied over the verdict, approached the higher court, which ordered adjournment of the case to September 30 for issuing its ruling.
