Yob resisted arrest

A vicious Moodiesbur­n lout assaulted a stunned cop and violently resisted arrest during an angry confrontat­ion, a court heard last week.

Robert Whyte will have to carry out unpaid work in the community after kicking the stricken male officer on the body.

The aggressive 37-year-old also struggled violently and lashed out at two constables with his arms and legs while they tried to take him into custody from the scene on Hilltop Road, also in Moodiesbur­n.

The disturbing incident took place on August 29 last year and Whyte, of Braeside Avenue, had to wait to discover his fate following deferrals for background reports and restrictio­n of liberty assessment after admitting his guilt.

Whyte returned to Airdrie Sheriff Court last Wednesday, when defence solicitor Rowan Myles told the court his client’s report was “fantastic”.

Mr Myles added that Whyte had taken it upon himself to tackle his issues with booze, saying: “He has undertaken work with Alcoholics Anonymous and been out of trouble since [this incident].

“I wonder if the court can deal with this by way of a community payback order or a restrictio­n of liberty order?

“He is in a position to carry out unpaid work.”

Sheriff Morag Galbraith adhered to this request and told Whyte: “Given the passage of time [ since the incident] and the steps you have taken, I will impose a community payback order with 70 hours’ unpaid work, which you will do within the next five months.”
