Abusive texts to ex and threats to her new man

- Court Reporter

An Airdrie man who sent his ex-girlfriend abusive texts before threatening her new partner has been fined and placed under supervision.

Jealous Gary Fisher, 32, threatened to kick his former lover’s door down and called her a“f****** dirty slut”in messages delivered on December 22.

Later that day the Wester Mavisbank Avenue resident, who pleaded guilty to his actions, told her new boyfriend that he was a“dead man”.

Fisher resurfaced at Airdrie Sheriff Court last week for sentencing and the procurator fiscal explained:“The complainer was in a shop at the till point but indicated he didn’t have enough funds and would go to a bank machine outside.

“As he did, he came across the accused, who began to shout,‘you’re a dead man’in his direction.

“He then shouted,‘come over here and you’ll be going home in a van tonight’.

“The complainer became concerned for his safety and the matter was reported to police.

“They traced the accused shortly after.”

His defence solicitor Luke O’Curry said:“This was a result of him drinking to excess.

“His behaviour resulted in five days custody and he has owned up to his actions.

“He and his partner had been together for 10 years but separated.

“She made a decision that she wouldn’t let her kids go to his home as it became apparent on the phone that he was intoxicated.

“That’s when the texts were sent and he recognises he shouldn’t have done that.

“He knows he must adapt his reactions in certain situations and to childcare.

“Mr Fisher wants to be a family man and put this matter behind him.

“He is in full-time employment and is in position to pay a financial penalty.”

Sheriff Petra Collins said: “Supervision will assist with your attitude and this will last for a period of nine months.

“On charge two relating to her current partner, you will be fined £100.

“I have reduced this from £150 due to your plea.”
