Drunk tried to kiss woman in petrol station

An Airdrie man who tried to kiss a Coatbridge petrol station worker has been tagged.

Sean Fagen, 33, repeatedly tried to kiss the woman on the lips at Main Street’s BP garage in May. When rejected, the Raebog Crescent resident kissed her on the cheek.

At Airdrie Sheriff Court the procurator fiscal said: “At around midnight, the complainer was in the locus and saw the accused enter before making his way to the counter.

“He began talking to the complainer who quickly became of the opinion that he was under the influence of alcohol or drugs.

“He leaned over and tried to kiss her on the lips but she turned away and it landed on her right cheek.

“He then did the same thing again.

“The complainer then moved away and went to the back of the shop to contact police.

“He was then asked to leave and he obliged.”

Fagen’s defence solicitor Paul Belardo said:“My client is remorseful for his actions and he’d had far too much to drink.

“He’d benefit from supervisio­n and some direction with his alcohol abuse.

“He’s anxious to avoid prison and is terrified of that prospect.”

Addressing Fagen, Sheriff David Young said: “I’m aware of the effect your drinking has on the safety of others.

“I’ve got to consider that.

“I’m being asked not to send you to prison, the question is, is there any point in listening to that?”

After Fagen replied “yes”, Sheriff Young continued:“Very well, I’ll place you on a community payback order for 24 months and you must follow the instructio­ns of your officer.

“I’ll fix a review for three months from now.

“I’ll also make a restrictio­n of liberty order for 11 weeks, during which you must remain in your home from the hours of 7pm to 7am.”
