Kicked and punched by partner

-

A man was kicked and punched when his partner began behaving violently towards him.

Charlene Ashcroft attacked her stunned victim at their home on Caldercruix’s Progress Drive on September 1 after returning from a party.

Ashcroft, 32, behaved aggressively and swore at her partner during her terrible tirade.

She appeared for sentencing at Airdrie Sheriff Court last week, when the procurator fiscal said: “Her and the complainer had been in a relationship for 14 years.

“At around 1.30am, the complainer was in his home address when the accused returned from a party.

“She entered the living room and informed the accused she’d had an argument with another female at the party.

“The complainer went to bed to avoid a further argument and she followed a short time later.

“She was angry and kicked him and punched his back before shouting, ‘get out my house, you b******’.

“She continued to shout and the police were called.

“When they arrived, the accused was cautioned and charged.”

Ashcroft’s defence solicitor said: “Despite the nature of this offence and some previous offending, there are background difficulties.

“She’s now abstinent from alcohol and has been since this incident.”

Passing sentence, Sheriff Frank Pieri informed Ashcroft: “I will impose a period of supervision for a period of one year.

“You must do as you are told by your presiding officer.”

Order failure

A man has been fined for only completing a certain amount of his community payback order.

Kevin Crawford, 25, from Gartness Drive in Airdrie, was given the order in May for an assault on his partner.

He also had cocaine in his possession at Coatbridge police office after being arrested.

After Crawford admitted the breach, Sheriff Frank Pieri said: “Given the difficulties, I will impose a financial penalty.

“You’ve completed a number of hours so far so I’ll revoke the order and impose a financial penalty of £300.”

Breached order

A man who has breached his community payback order will return to court once reports have been completed.

Gary Weir, 28, of Bellshill, was punished for carrying a knife in Motherwell in May 2016.

He then didn’t disclose it was on his possession to an officer who was searching him at Coatbridge police office, leaving him open to the risk of injury.

Weir now may be tagged for the breach.

His defence solicitor said: “A report was done in June 2018, so I’d suggest a deferral for fresh reports due to the time frame.”

Sheriff Frank Pieri agreed: “Yes, I’ll leave this for Sheriff Mercer to deal with once fresh social work reports have been done.

“I’ll also call for a restriction of liberty suitability assessment.”

Needs to wait

A Coatbridge thief may be tagged at the start of next year.

Patrick Strain, 37, appeared at

Airdrie Sheriff Court last week to face punishment for two thefts and an aggressive incident in Shawhead.

He nicked groceries from the Faraday retail park’s Poundland store in May and alcohol from a shop on Whifflet Street in August.

In June, he behaved aggressively on Shawhead Avenue and caused fear and alarm by striking the door of a property, entering it uninvited, uttering offensive remarks and threatening violence.

Sheriff Frank Pieri deferred sentencing for social work reports and a tagging assessment.

Threats to kill

A man will be sentenced in January for brandishing a glass bottle during an aggressive episode.

John McLean, 28, uttered threats to kill and refused to leave a Merrystone Court property in Coatbridge on September 29.

McLea n , f rom

Whifflet Court, hadn’t complied with attempts to get reports before the sentencing, but his solicitor explained why that was the case.

He said: “His address needs to be updated and that’s why there’s no reports; he didn’t know about the appointments.”

Sheriff Frank Pieri said: “Very well; I’ll continue for the reports to be done.”

She was angry and kicked him and punched his back before shouting, ‘get out my house, you b******’
