Parking in the cycle lane is totally legal

Police and wardens can’t issue tickets

- Stephen Houston

This picture shows how easy it is to bring Ayr’s unwanted cycle expressway to a grinding, crashing halt.

Parking just one vehicle on the Holmston Road blocks it completely.

And we can exclusively reveal that it is perfectly legal to park right on top of the cycle path.

Without double yellow or solid white lines police and wardens cannot issue tickets or have the car removed.

And it is expected that the lack of an official road traffic regulation could lead to a free for all parking campaign by protesters.

On Thursday a Volkswagen Caddy was left for hours right on the track.

It was parked at one of two places where it is possible to get vehicles onto the track despite the line of bollards.

One access point adjacent to the River Ayr walk can house multiple cars. And one resident said: “We could get a right line of vehicles in there.

“We would all have to ensure that we didn’t block each other in, but the feeling is probably strong enough for some direct protest.

“And if we are not breaking any law then I think it shows the folly of the whole thing.

“First nobody in the council knew about it, now anyone can put a spoke right in it.”

Other vehicles have been seen parking on the track since it was completed earlier this month.

It has left a number of homes with no space outside for visitors to leave their cars.

The Ayrshire Road Alliance confirmed this week that there is nothing to stop cars blocking the track.

A spokeswoman said a traffic order would have to be active for any action to be taken.

She said: “Currently there is no traffic order in place for Holmston Road and our monitoring confirms that drivers are being sensible and considerate and parking elsewhere now the cycle lane is in place.

“We will continue to monitor the area and, if parking becomes an issue for the flow of traffic, we may consider the introduction of a traffic order and the extension of parking enforcement to this area.”
