Brute jailed for vicious assault on his partner

A man with a “significan­t record” of conviction­s for domestic matters has been caged after carrying out a brutal assault on his partner.

Derek Nisbet grabbed Michelle Seaton by the hair before dragging her into a living room and repeatedly punching her on the head and body.

Nisbet appeared from custody at Ayr Sheriff Court on Thursday November 28.

The 37- year- old admitted assaulting Michelle Seaton on October 26 this year by seizing her by the hair, dragging her along the floor and repeatedly punching her on the body and kicking her on the head, to her injury.

Fiscal Depute Ed Sheeran told the court the accused and complainer had been in a relationsh­ip for eight years. The offence unfolded at around 8.30am in Auchinleck’s Lambfair Gardens.

He told the court: “The complainer got up and returned to bed but the accused told her to get up as it was time to go to the chemist.

“She said she would go later in the day but he told her ‘ Get the f*** up and pulled the quilt off her.

“He repeatedly punched the complainer to the back of the neck and shoulders before taking her to the living room, where the assault continued.

“The complainer was dragged along the floor and she sustained carpet burns on her knees and elbows.

“He kicked her to the right side of her face with his feet before the accused left the living room.”

The victim used his mobile phone to call 999.

During the disturbanc­e a downstairs neighbour heard noise and likened it to an “earthquake” and heard the victim shout three times ‘ Don’t hit me.’

Mr Sheeran said: “Police attended and found the complainer crying and shaking. Police also noted some bruises to her neck, small scratches and other bruises but she did not need medical attention.”

Robert Logan, defending, said: “He’s got a significan­t record of conviction­s for domestic matters.

“They are both on methadone prescripti­ons and have to attend at a certain time for dispensing.

“He accepts what he did but what’s omitted is that Ms Seaton was shouting and swearing. The cause of the ‘ earthquake’ was due to her pushing a CD rack and throwing it on the floor. But this in no way justifies what he did.”

Sheriff Colin Dunipace said to Nisbet: “This was an absolutely appalling attack. You have a terrible record of crimes of violence and there is no other alternativ­e other than a custodial sentence.

Nisbet, of Lambfair Gardens, Auchinleck, was jailed for nine months, backdated to October 28.

A non harrassmen­t order was also obtained, meaning Nisbet cannot contact his victim for the next two years.
