Chocolate thief given warning

In terms of the theft fiscal depute Craig Wainwright said: “CCTV was reviewed and he was captured taking two boxes of chocolate but made no attempt to pay.

“He was apprehende­d a short distance away. He was cautioned and charged.”

The value of the chocolates was £ 14 but there was no recovery.

Glenn Davis, Hutchison’s defence solicitor, said: “There is no doubt he’s the author of his own misfortune.

“He’s anything but an unwilling worker.

“From time to time he has a compulsion to behave like the class idiot , showing off and being the life and soul of the party.

“But he has difficulti­es in accepting when the line is to be drawn.

“He’s got quite a ( criminal) record but managed to stay out of trouble for four years, something of an achievemen­t .”

In relation to the incident with the supervisor Mr Davis said: “He turned up trying to get an extra shift but ended up shooting himself in the foot.

“He’s subject of another community payback order ( 150 hours) but he’s making significan­t inroads into that, completing 46 and a quarter hours out of 150 that were imposed.”

Sheriff John Montgomery told Hutchison: “You’re sailing very close to the wind again. You’re fast running out of chances.”

He was sentenced to 120 hours of unpaid work in the community, to be completed within six months.

Sentence on the theft was deferred until June 4 in order to obtain a supplement­ary criminal justice social work report.

Hutchison was also fined £ 300, payable at £ 20 per week.
