Takeaway driver fled after killing man on road

A SMETHWICK takeaway driver who killed a man while he crossed the road has been told he faces jail.

Mohammed Hussain’s ‘momentary inattentio­n’ caused the death of a Gloucester man as he crossed Kingsholm Road in Gloucester last year.

This week Hussain was banned from driving after he fled the scene on September 28, 2019. Steven Bone was hit by a Mercedes C250 car driven by Hussain and died three weeks later on October 18.

Hussain, 22, of Marshall Street, Smethwick, was later arrested after police tracked the car down to the Gloucester takeaway having checked its number on CCTV footage.

At Gloucester Crown Court Hussain, admitted causing the death of Mr Bone, 54, while driving without insurance. Hussain, who did not stop at the scene, also admitted failing to stop after an accident and failing to report it, as well as other offences of driving without insurance while he delivered food to customers that day.

He pleaded not guilty plea to causing death by careless driving which was accepted by prosecutor James Ward who told the court it had always been the Crown’s case that Hussain was speeding but checks revealed he was doing only 24-28mph. “A moment’s inattentio­n is now really what this case is about,” he said.

“He says he thought he was insured for the vehicle he was driving that night on behalf of a takeaway restaurant.

“It is clear he did have insurance for his own vehicle.”

The court heard a police report said a street lamp should have been working but was not which Judge Michael Cullum said “added to the problems with the rain”.

Judge Cullum ordered a pre-sentence report on Hussain and bailed him until September 2 when family members of Mr Bone’s are expected to be present for the full hearing of the case.

The judge imposed an interim driving ban and told him:

“Clearly this is a serious matter. “The guidelines do have a custodial sentence as the starting point so you are at risk of an immediate prison sentence.”
