Is Nokia responsible for faulty handset?

-

The Nokia C01 Plus phone Q (pictured) I bought in 2021 no longer receives texts. Thinking it was a problem with my SIM card, I went to O2 and the assistant tried the SIM in a new phone. A hard reset worked briefly, but the problem keeps reappearing. Nokia offered to fix it for £80. Should I pay it? Raymond Dalgleish

A No, Raymond shouldn’t pay this because his contract is actually with Argos, the retailer he bought the phone from. He needs to contact Argos, but before doing so he should try some of the solutions to the problem that have been suggested online (www.snipca. com/49529).

If they don’t work, he should tell Argos about his problem and say that it’s a well-known fault that’s been discussed online. Argos may decide to refund him straight away, though it’s allowed to deduct money to reflect how long he’s been using the phone. It’s also allowed to offer a repair or replacement, but not both if one of these fails.

However, because more than six months have passed since purchase, Argos can ask Raymond to prove that the phone is faulty. If so, he’ll have to pay for the phone to be inspected, but if a fault is found Argos will have to refund the cost.

We’ve asked Raymond to tell us whether any of the fixes work. In the meantime we’ll ask Nokia whether it knows what the problem is. CASE ONGOING
