The murder charge was prompted when a faded decades-old picture was posted on Facebook in 2015 of Paul with Dearlove, who now lives in Great Yarmouth, Norfolk.
Paul’s eldest brother, Peter Booth, 53, said the photo brought back a memory of witnessing the alleged murder when he was three.
He said he saw Dearlove swinging Paul by his ankles and smashing his head on a mantelpiece.
Mr Booth has told how Dearlove would hold him under bathwater until he thrashed around trying to catch his breath and said he was punched, kicked and beaten regularly.
Dearlove, who denies murder, manslaughter and three charges of cruelty, claims Paul fell out of bed. An inquest at the time recorded an open verdict.
But prosecutor Mr Wright said: “The death of Paul Booth had been no accident, it had been the result of a deliberate act. It had been murder.”
