A BRITISH tourist who died in a balcony fall in Benidorm had not taken drugs but had been drinking, a toxicology report has revealed.

Kirsty Maxwell, 27, had a blood alcohol level of 2.79 grams per litre, more than five times the Spanish drink-drive limit. No illegal substances were found in her system.

The results come ahead of a July 26 court hearing in Spain, where four British men – whose holiday flat Kirsty fell from on April 29 – will be placed under formal investigation.

Ricky Gammon, 31, Anthony Holehouse, 34, Callum Northridge, 27, and Daniel Bailey, 32, named as “investi- gados”, will be quizzed by a judge. A fifth man, Joseph Graham, 32, who has already given evidence, will not appear. The men deny any wrongdoing. Their lawyer, Roberto Sanchez, said: “The alcohol in Kirsty’s blood was sufficient for a person to become disorientated and for the accident to occur.” Kirsty’s family lawyer, Luis Miguel Zumaquero, said yesterday: “Kirsty’s friends said they had been drinking. But that doesn’t justify her throwing herself out of an apartment with five men inside.” Kirsty, of Livingston, West Lothian, died while on a hen do, after mistakenly entering the men’s apartment.
